These Terms of Service (“Terms”) govern your access to and use of Brainstormd (“the Service”). By using the Service, you agree to these Terms.
1. The Service
Brainstormd is a note-taking application that you can use locally on your own device, with optional cloud and AI features available through an account.
2. Accounts
Some features require an account. You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for the activity that happens under your account. You must meet the minimum age of digital consent in your jurisdiction.
3. Subscriptions and billing
Paid plans are billed in advance through our payment provider on the schedule you select and renew automatically until cancelled. You can cancel at any time from your account; the cancellation takes effect at the end of the current billing period. Prices may change with reasonable advance notice.
Refunds are provided where required by applicable consumer law. For other refund requests, contact us.
4. Acceptable use
You agree to use the Service lawfully and respectfully. You will not use the Service to violate the rights of others, store or transmit illegal or harmful content, attempt to disrupt or reverse engineer the Service, or evade rate limits and access controls. We may suspend or terminate accounts that violate these rules.
5. Your content
You keep all rights to the content you create. To the extent you upload content to our infrastructure, you grant us a limited license to store and transmit that content solely for the purpose of providing the Service to you. We do not use your content for advertising or model training.
6. AI features
Some features rely on third-party AI models. AI output is generated probabilistically and may be inaccurate; you are responsible for reviewing output before relying on it. We do not warrant the accuracy of AI-generated content.
7. Availability
We aim to keep the Service available but do not guarantee uninterrupted access. Local features of the desktop app continue to work offline.
8. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amounts you have paid us in the period preceding the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if required by law.
11. Changes
We may update these Terms from time to time. Material changes will be communicated before they take effect. Continued use of the Service after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Brainstormd is established, except where mandatory consumer law requires otherwise.
