These Terms of Service (“Terms”) govern your use of Brainstormd (“the Service”). By creating an account or using the Service, you agree to them.
1. The Service
Brainstormd is an online infinite whiteboard that runs in your web browser. Boards are saved to your account. You can share them with other people and use an optional AI assistant powered by an API key you provide.
2. Your account
You need an account to create boards. Keep your sign-in details secure and the information you give us accurate. You are responsible for activity under your account. You must meet the minimum age of digital consent where you live.
3. Plans and billing
The Free plan costs nothing. Pro is billed in advance, monthly or yearly, through our payment provider (Stripe), and renews automatically until you cancel. You can cancel at any time from Plans & billing; cancellation takes effect at the end of the period you have paid for. We will give reasonable notice of any price change before it applies to you. Refunds are provided where consumer law requires; for anything else, contact us.
Pro features apply to boards you own. If your Pro plan ends, your boards stay yours, but collaborators you invited can only view them, and version history stops recording, until you upgrade again.
4. Sharing boards
As a board's owner, you decide who gets an invite link and what role they have, and you are responsible for the people you invite. Anyone with a valid link can join until you revoke it. Content that members add to your board becomes part of your board.
5. Your content
You keep all rights to what you create. You give us a limited licence to store, process, display and transmit your content only as needed to provide the Service. That includes showing it to the people you share a board with. We do not use your content for advertising or to train AI models. You can export your boards at any time.
6. The AI assistant
The assistant sends requests from your browser directly to the OpenAI- or Anthropic-compatible endpoint you configure, using your own API key. Your use of that endpoint is governed by your agreement with its provider, and any charges it makes are between you and them. AI output can be wrong or unsuitable. Review changes before you accept them, and don't rely on them without checking.
7. Acceptable use
Don't use the Service to break the law or infringe anyone's rights. Don't use it to store or share harmful, abusive or illegal material, or to harass people. Don't attempt to disrupt, overload, probe or reverse engineer it, or get around limits and access controls. We may remove content or suspend accounts that break these rules.
8. Availability and changes to the Service
We work to keep the Service available and your boards safe, but we don't guarantee uninterrupted access or that it will be error-free. We may change or improve features over time. We will give notice before removing something central to a paid plan.
9. Disclaimer
To the extent the law allows, the Service is provided “as is” and “as available” without warranties of any kind, express or implied.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim is limited to the amount you paid us in the 12 months before it arose.
11. Ending your use
You can delete your account at any time in Settings. We may suspend or close accounts that seriously or repeatedly break these Terms, or when the law requires it. Where we can, we will give you the chance to export your boards first.
12. Changes to these Terms
If we make material changes, we will tell you before they take effect. Continuing to use the Service after that means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction where Brainstormd is established, except where mandatory consumer protection law gives you other rights.
